Legal Question in Family Law in New York
Grounds for Divorce
My spouse and I were married for 19
years, have been physically separated for
8 years, and we have a court ordered
spousal maintenance that he pays me. He
has filed for divorce on grounds of
adultery with cruel and inhuman
treatment. While we were together I didn't
have sexual relations with another, but for
the last 4 years I have. We both want a
quick divorce and he knows of my present
relationship. The divorce is supposed to be
as amicable as possible and neither is
contesting. My concerns are what possible
ramifications I might be subjected to if I
agree to the grounds, and if there would
be other grounds we could use.

Re: Grounds for Divorce
I agree with David. There are no "ramifications", however, it is better for all individuals to agree to an uncontested divorce under the grounds of abandonment.

Re: Grounds for Divorce
There are no ramifications whatsoever. The records of your divorce will be sealed, available only to the parties and their attorney.
However, if you're in agreement on the terms of the divorce, you may feel more comfortable with other stated grounds, such as abandonment.
