Legal Question in Family Law in New York

Grounds For Divorce

I have been told by two attorneys that I do not have grounds for divorce in NY. Incompatibility, strife, being out of the house for over a year and so on doesn't count. What can I do?

I suggest you consult with an experienced matrimonial attorney, who may be more astute in recognizing grounds, or in negotiating a settlement.

Re: Grounds For Divorce

Incompatibility in itself is not grounds for divorce. Living separate and apart pursuant to a separation agreement or decree is a common set of grounds. Constructive abandonment is another. If the two parties can agree as to grounds you are always better off!
