guardianship questions

I have some questions on guardianship of a disabled (temporary} adult. What responsibilities do I have if I have gaurdianship as far as medical, personal and property.

Am I responsible for debts incurred before taking gaurdianship? Will I be responsible for all medical bills after insurance? Any help you could give would be appreciated.

A guardian can have very broad or very limited powers, depending on the order. You are not personally responsible for the AIP's debts. Feel free to call me at 212-367-9167 to discuss this further.

This is a tremendous responsibility you have taken on. You deserve my highest respect for your act of devoting yourself to the welfare of another person in this way.

Your responsibility is to assist the other person and to manage their financial affairs. You have no personal liability (in the absence of fraud) for any debts. Your responsibility is to make sure appropriate debts are paid and that any money/income of the other person is responsibly managed. You will never be second-guessed or required to be perfect. Your job is to act responsibly and reasonably. Basically, to act like a normal person and not do anything foolish or weird.

The debts you must pay from the financial assets of the disabled person include medical and other debts that are incurred both before and after you take on your responsibility. It does not include paying debts where the disabled person was taken advantage of by an unscrupulous salesperson. Use your own judgment with confidence, you will not be second-guessed.
