Legal Question in Family Law in New York
Guardianship
My 21 year old daughter is expecting a baby. She is unmarried and is living with us, is in college and has a part-time job.
She is covered on our medical insurance as long as she stays in school but the baby will not be covered. If my husband and I adopt or become the child's guardian could it then possibly be covered on our insurance and what other advantages and disadvantages will there be to doing this?

Re: Guardianship
Before looking into adoption, New York State has a program called New York State Child Health Plus. I believe free medical insurance is given to children. To obtain more information you can contact New York State Department of Family Assistance. There is an 800 number. The email address is [email protected]
Please email if free insurance is given to child. Thanks,
Mike.
Re: Guardianship
If you adopt the baby then all of the medical should be covered under your medical insurance. After the baby is born you should have the attorney who represents you in the adoption write a letter to the insurance company requesting that the baby be put on the insurance plan back to the date of birth. The rest of your question is complex. Emotionally there are advantages and of course disadvantages to doing this type of adoption. You may want to explore a custody option rather then the extreme of adoption. Also where is the birth father? In order to do an adoption in NY you will need his rights to be terminated either voluntarily or by a court order. If you would like to discuss this further you can call us at 516-677-0028 ext. 212. Good luck.
