Legal Question in Family Law in New York
I am being harassed during the divorce
My brother is currently going thru a divorce in Saratoga County, NY. His estranged wife calls his place of employment and harasses him or any one that answers the phone about the divorce issues. He took hi children to my parents house for Christmas (it was a court ordered visitation) and when he got there the police were waiting for him because he called the local police and told them that she kidnapped the children. We are from a small town in OK and this was very humilating for my parents. What can be done to stop her harassment of him and the entire family?

Your brother should definitely bring this up in court. He should have his attorney file a motion regarding this harrassment. The family may be able to sue the soon-to-be-ex-wife over the incident at christmas, but should consult an local attorney.

If this case is pending in Saratoga County Supreme or Family Court, the Court should and can be made aware of what is happening. It is likely that your brother could be awarded an order precluding her from contacting him at work, etc. and the court might issue a warning and/or a further order regarding custodial issues.
