Legal Question in Family Law in New York

Hello,

I have been divorced for two years now, and have been receiving child support of $900/month. Lately, he has been giving me money 3x a month (instead of full amount at once) to make up for the $900 he owes me. He's been complaining that he doesn't have money for me, but I have found out that he's doing extra activities. My question to you is, would I be able to go through social services to apply for child support and receive it that way so at least it's in my account on a specific date of the month even though he is paying me, but is having difficulties at times.

Thank you

Judy

Yes. You would receive payment through the Child Support Collection Unit. The easiest way to do this is to petition the Family Court for an Order.

Using the CSCU is your right. There is no defense to the petition.

Mike.
