Legal Question in Family Law in New York

Hello,

I now live in New York, but was divorced in Texas where my son and my ex still reside. My divorce documents state that I must keep my child on my health insurance policy. I have no health insurance for myself, as I am a veteran and use health services provided by the Veterans Association. I have tried several times to get a policy just so that I can get my child health coverage. Unfortunately every insurance company says I cannot insure my child under my NY health insurance as long as he is living in Texas. In the past my ex has placed our child on her health insurance policy (I still pay the premium) through her current employer, but will be cancelling it shortly and is demanding that I get him coverage despite my predicament. I just got a job with full benefits that should cover my child as well, but I wont be eligable to recieve these bennefits for three months. She will be canceling her insurance policy in less than three months, and I am not sure what my options are. I am trying to get information/suggestions, and try to make sure I dont get into any legal problems. Thank you for your help.

When ex's insurance is canceled, the son should be provided COBRA coverage. You would be responsible to pay for the COBRA until your insurance coverage is eligable in three months time.
