Legal Question in Family Law in New York
Hello,
I am a 20 year old fairly successful financial consultant living in New York. I recently impregnated my girlfriend of one year and she wishes to have the baby. I will absolutely support my child in every single way but I am not ready to get married. This is mainly because for some time I have had the suspicion that my girlfriend does not love me, just the money I can bring home. I want to know what her rights are in this case. Child support? (Not a problem my child will have it all). Can she get anything else? Also we do not live together yet. Please help as I am in a bad position. Thank you.
Sincerely,
Distressed Banker

You are indeed in a difficult position, and should discuss your situation in detail with a family law attorney.
Generally, child support in New York is structured around the income of the non custodial parent. The Child Support Standards Act sets what is usually regarded as the floor in child support, with basic support for a single child set at 17% of the non custodial parent's income, with that income capped (in some cases) at $135,000 per year. But that's not the end of the discussion - and there are circumstances in which the cap can be exceeded.
If you'd like to discuss the matter in detail as it would apply to your circumstances, please feel free to get in touch.
It wouod seem given e circumstances you will only likely belaying choked support, and dependent on income what level of support you will be forced to pay by the court could vat greatly.
