Legal Question in Family Law in New York

holidays

my divorce papers are very flexible in terms of visitation on holidays...it says that both my ex and i should come to agreement...well, that doesn't happen...i have physical custody of my son and we share legal custody...he has visitation every other weekend...he claims that he can take our son out of town on christmas and i can't say anything about it...our son is 7 and should wake up in his own home on christmas and should be with both of his parents on that day...i want to get my papers amended to specify that neither parent can take our child out of town on x-mas...help!!

What does your attorney say about this problem?

If you do not have an attorney, suggest you schedule a confidential attorney / client consultation with an experienced matrimonial attorney.

The terms of visitation can be modified by the court, in the best interests of the child.

The issues of custody and visiation, which is a specie of custody, are always before the court.
