Legal Question in Family Law in New York

I would like my home back

After 21 years in an abusive marriage,I left my home and moved out with my children.I need to find a new place to live now and would like to move back in to our house with our children.My husband is there but spends many nights at his girlfriends house. He refuses to let me and the children move back into our home.Do I have a legal right to move back into the house with the kids?

Re: I would like my home back

If you can show that it is or would be unsafe for you to reside in the house with your spouse, you could be awarded exclusive possession of the former marital home.
