Legal Question in Family Law in New York

Can she take my house and property?

I received a letter yesterday from my wifes attorney in Brooklyn, NY. My wife is filing for divorce after our having been separated for six years. In the papers from her attorney it says that my wife is not asking for any property, or money. She just wants me to sign it quickly so that it can then be placed in on ''uncontested divorce calendar''

I live in Missouri and she filed in NYC. Should I believe this, sign it and send it back? Or should I check and see if she has struck it rich while she is there and ask for money and property from her?

I woulnd't want to let her go if she has become a millionaire while I'm still existing on $900.00 a month or less.

Re: Can she take my house and property?

NY is an Equitable Distribution (Common Law)Property State. Which means that if you and your wife, did not acquire any property TOGETHER, it is VERY unlikely a NY Court would award you a share of ANY property, your wife may have acquired or accumulated separately, without contribution or effort from you.

Good luck,
