Legal Question in Family Law in New York

House rights

Hi, I've been married for a short time (4 Months), my husband and I purchased a house in NY right before the wedding. To be exact, he put all the money for the down payment and I helped him to pay other things not related to the house. I covered the wedding expense. The house is under both of our names. My question: In case of separation, do i have any rights on the house eventhough I did not put down any money to buy it? is it a 50-50 deal ?

thanks.

Re: House rights

You may have a right to 50% of the house, but that depends on all of the facts. Is your name on the deed? Do you have records for all of your expenses? If you wish to discuss this more fully, please call at 518-383-1182 and speak with Alexis to schedule a consultation.

Re: House rights

If you have detailed records regarding your expenditures you may have some equity in the house.Since the house was purchased prior to the marriage ,it may not be considered a marital asset. It is possible to remedy this by a post nuptial agreement. You may call my office @718-834-0087 to set up a consultation.

Re: House rights

The fact that he put your name on the deed might constitute a gift and you would have rights to the property. call me for a free consultation at 516 466 5297
