Legal Question in Family Law in New York

can he?

he has been out of the house for over 2 years now. we have been through custody and support, im waiting for him to start the divorce since i cant due to the soldiers and sailors act. i want to start a ceramic shop and will go for a city loan, can he take half of this on me if the divorce is just started?

Yes. He is entitled to half of the marital assets. Marital assets are assets accumulated during the marriage. Why not see if he will agree to waive any claim to it. If you have worked out custody and support you are ahead of the game. Try to see if you can work this out as well.
