Legal Question in Family Law in New York

getting my huband to leave

I have been married for 1 1/2 yrs. I rent a house from my ex-in-laws, I hae three daughters faroma previous marriage, we have no children together, we have no joint assests, his name is not on the lease. How can I make him leave? I want to file for a divorce, should I wait until he leaves?
