Legal Question in Family Law in New York

My Husband and I are looking to get divorced. We signed separation papers in May of this year. Since that time he has left the country to return to where he is from and will not be returning to the states. How long do I now have to wait to get divorced, and how do I go about doing that when he is not here for the process.

1. You do not need to wait any longer. You can file for "no-fault" divorce right away.

2. Regardless of which grounds you file under, he will need to either (a) sign & notarize papers where he is, or (b) be served papers.
