Legal Question in Family Law in New York

My husband and I entered into a legal separation. He was to place 10 K into an escrow account to become mine in 1 year if we were not reconciled. He was to pay me 350 per week in spousal maintencance for that year.

He never put the 10 K in the attorneys escrow account,went to Europe and says he will never pay me anything.

What is my recourse...what are the penalties for what he has done?

Assuming you have a properly drafted and signed agreement, you can go to court to enforce it. Penalties, if any, would be defined in the agreement.

You are going to have serious problems until he reenters the United States. You should go to court in New York to get a judgment against him but until he comes back to the U.S. it will be very expensive to execute on or enforce the judgment. If you get a judgment against him you can attach any assets he has here but you need to act.
