Legal Question in Family Law in New York

My husband and I filed for an uncontested divorce last month after filing a marriage separation agreement in Aug. 1, 2005. The clerk who drew up our papers made a mistake and put Aug. 1, 2009, so the divorce was denied. Now we have to refile. The problem is the lawyer wants to charge us again. I have contacted other lawyers but haven't heard back yet. I have all the (corrected) papers. Can I just refile them? Do I need a new index number? What do I do with the request for judicial intervention when it currently says no judicial intervention has been asked for before?

Corrected papers can usually be filed without a problem. If you have already filed an RJI and are filing in the same index number, you won't need another RJI.
