Legal Question in Family Law in New York

My husband and I have lived separately for 1 calendar year, (New York State) can we file for uncontested divorce? or do we need to have a legal sep agreement for 1 year, still?

Generally, if a spouse willfully leaves and abandons the other spouse for over 1 year, and the abandonment was without cause and consent, that constitutes grounds for a divorce.
