Legal Question in Family Law in New York

My husband has been living in my home, I consider us no longer married in the sense of marriage, We don't share living quarters. He lives down stairs and I up stairs, living separate lives. My husband has threaten my life and to do harm to me. I own this home it was left to me by my parents. The question is i want him out of my house. How do i go about having that done legally, while i file for divorce.?

Consider filing an action for divorce and request a restraining order in which you will be required -under oath- to state the facts and circumstances outing why your life is in danger and a restraining order is necessary.
