Legal Question in Family Law in New York

Husband has not received summons for child support hearing...

My husband just found out that he has a court date for this Friday. His ex wants to increase child support in addition to requesting private education expenses. We do not have anymore money to pay for a lawyer at this point as we have put in almost $10K last year just fighting for his daughter in general. We need another month to fight this. He has not been served yet for court. He found out by calling. He cannot retain a lawyer in one week. Is there anything we can do to postpone the hearing or will they go ahead with the case regardless if he is not served? We are in New York State.

You can ask the court for a continuance so that you can obtain a lawyer. The court most likely will go along with your request. Is the court located in CT or NY?
