Legal Question in Family Law in New York
My husband recently had an affair. The woman he had the affair with is claiming she is pregnant with his child. She first was requesting money for an abortion, then threatened to ruin us, then came back and asked for more money for an abortion and now has gone back to threatening my husband, me and my 10 yr old daughter. We have given the woman the money to she requested as she promised she would have an abortion with the money given to her. She has not yet had the procedure and is now asking for more money before having it done. She is threatening to have him arrested for assault and rape if he doesnt give her the additional money and has said that her attorney has advised her to have an unwanted child just so she can sue him. Can she do this? Do we have any protection? Can she come after me? Can she have me served at my office for my husbands DNA of which she has threatened to do to cause me embarassment. Is this extortion? Harassment?? Do I have any protection?

Do not give her any more money. Your husband should clearly tell her not to contact him any more. If she contacts him again anyway, he can file a complaint with the police for harassment. If he is served with paternity papers or any other legal documents he should immediately consult with a family law attorney.
