Legal Question in Family Law in New York

My husband recently found his son after 20 years, his son is now 21. They separated when his son was one (the mother moved around and did not keep in touch). My husbands son does not have my husbands last name nor is my husbands name in his sons birth certificate, my question is how does my husband give his son his last name (his son wants to change it). My husband and his son are bonding well, his son is an amazing person. Any advise is welcomed, thank you.

His son has to petition the court to change his last name to his father if that is what he wants.
