Legal Question in Family Law in New York

my husband and i separated last july, we made up a separation agreement in november. unfortunately neither of us have consulted with a lawyer because its going to be a contested divorce so i figured i could do without. i read online i didnt have to file the agreement with the court so i havent. do i have to file it? if i do, do i have to wait til one year after filing with the court before i can petition for divorce?

If the separation agreement is not properly drafted, properly filed and properly obeyed, you will not be able to file for divorce based upon the agreement.
