Legal Question in Family Law in New York

My husband and i are seperated. He lives in a differnt state than I. He hasnt seen his daughter in a year, but calls fequently. Is this abandment? If so what is my next step?

Based upon your question, I see two possible answers:

First, if you are talking about whether your husband abandoned you for grounds for divorce, yes he most likely has but you should contact a divorce attorney.

Second: if you are talking about your husband abandoning his daughter for custody issues, that is a different issue. Abandonment can take many forms but if the father is keeping in touch and calling then it most likely is not abandonment.

Either way, you should consult with a local family court attorney for more indepth analysis of your case.
