Legal Question in Family Law in New York
Husband has threatened me, what do I do?
I am married to an abusive man for 36 years and have two adult children living out of state. My husband has threatened me with guns. Last summer he assaulted me (not the first time). I felt that my life was in serious danger and filed a police report. They came to the home that night and removed all 5 guns. I am in the home fearful that he can snap at anytime. Last night I received a call from the police telling me that he wants the guns returned. They said that I must write a letter within two weeks, stating why I oppose this. I'm afraid that if I do this he will kill me and if I don't he will get the guns back. He is violent. I am MISERABLE and SCARED! We own the home and he has said that I should leave. I am afraid that he will be awarded the home if I leave. I also believe that he has hidden his assets. He does not give me a penny to spend for any household needs even though he earns well over $100,00 per year. He appears very pleasant in public but has a Jekyl and Hyde personality. I would GREATLY APPRECIATE ANYTHING THAT YOU CAN TELL ME TO DO OR NOT DO IN THIS SITUATION! I am VERY SCARED that I could wind up like LACEY PETERSON!

I would recommend that you see an attorney as soon as possible. Your attorney will provide you with the best course of action to take.
If you are concerned about legal fees, you should discuss with the attorney the likelihood that your husband will be required to pay at least some of your fees.

You should immediately obtain legal counsel from an attorney before deciding on a course of action.
You should also secure copies of all your personal papers at a location away from your shared home.
Joint tax, property records and filings can be acquired from the agency where the docs were filed.
You might also consider obtaining personal counseling, in order to acquire the mental and emotional support you will need to proceed through the changes in your life.
Good luck,
