Legal Question in Family Law in New York

My husband and I threw our 20 year old son out of the house because he is irrational, using drugs, pays no rent nor for any of his other expenses (car, car ins., phone, etc.) Today he accused my husband of beating the whole family - which is simply not true. Are we able to throw him out because he is an adult? Or will there be consequences?

I am not sure what you are asking. You state that you threw him out at 20. Is he back in the house and how old is he now?

If he is above the age of 18, you have a responsibility to support him but you do not have to have him live with you. As you state, he is an adult but you can be held to be financially responsible for him until he is 21 years of age. The consequences are mostly financial but if he is deemed to be mentally deficient you could be considered to have abandoned him. If this is the case, you should see local counsel to discuss the situation but if he is healthy and the only problem is a drug habit then you have less of an issue.
