Legal Question in Family Law in New York

income over 80K

My ex and myself are making more then 80K a year. According to NY guidelines, usually 17% is applied to the first 80K and child care plus medical is added to that. In what cases a judge applies 17% to NCP gross income which is 50K currently (I make 70K ).

Still subject to support

As you should know the rate, thoough based upon 17%, is subject to certain exclusions and may end up being a little less. however it is still a good working figure.

The courts generally apply the percentage to the income over $80k unless there is reason that shows a need for deviation.

You should consult with an attorney immediately to see if there are circumstances which calls for a modification of the amount over $80k.
