Legal Question in Family Law in New York

infant name change

hi, I wanted to change the last name for my daughter to my last name. In her birth certificate, her father's name is no present. Do I still have to contact her father to change the name? The problem, she was born in NY and now we are in Brisbane, Australia. I have no idea where her father is. Please help. Can I apply for the name change from Australia?

You can change your daughter's surname without making any application. You can also do it without her father's consent. It would be preferable to get his consent first. But if you don't know where he is that might not be possible. If he later objects he can apply to court. But it appears he has no contact with her so that would seem to be unlikely. If you want the bith certificate changed you will need to enquire with the authorities in New York if thats where her birth was registered.
