Legal Question in Family Law in New York

infidelity

i just found out my husband of 10 years has been having an affair for almost 2 years. once i serve him with separation papers, who has to leave the home? i have nowhere to go, he on the other hand owns a rental house (before marriage), has friends, family in town and/or can go to her house. i don't have anywhere but my home and i have a dog.

The mere fact that a matrimonial action has been commenced does not require either or both parties to leave the house.
