Legal Question in Family Law in New York

My In-Laws are stealing our son

About a year and a half ago, my son was expelled from public school for carring a knife. We spent the remainder of that school year home schooling my son. At the start of the next school year, my wife and I decided we could not continue on home schooling him and attemted to get him into a private school. After he failed to be accepted to the private school, my wife and I didn't know what else to do. We decided to send him to New York to be with his grandparents until he could go back to school in Michigan.

We were told that they would need joint custody of our son in order to enroll him for school, so we did. Now, the school year is over, and we want him to come home, but he and his grandparents are refusing. We want our son back and our family whole.

We tried to do what was right for our son, and now my in-laws are trying to steal our son. Will we be able to get him back?

I don't understand how you gave them joint custody as there was no action pending. Maybe you gave them joint guardianship. If so, you are in a strong position to get your son back. Of course, this will take legal action so consult with a good family law attorney. William S. Stern 248-353-9400
