Items in Household

Can I take household items out of the home while going through a divorce? I've heard that the husband and wife decide who gets what or the court. If it has been decided by the both of us who gets what.... when can I start moving things out of the house... even though I have to still reside there? Thanks so much.

If you both agree you can remove anything. I would advise to keep records of what was removed.

In order to avoid future misuderstanding and dispute, it is recommended that you take the time to do the following:

Everything in your HH should be inventoried or listed.

Everything listed should be designated "as going with..." H or W

Everything listed and "going with...," should be signed for, preferably notarized or before a witness.

Then proceed carefully and respectful of your mates feelings and concerns about removal.
