In NY state, if no civil marriage papers were ever filed is a couple married legally if they participated in a orthodox jewish ceremony?

Al pi halachah yes. However, according to the dinah malchota no. They need to go to the closest town hall and get a license. I'm surprised because the rabbi usually reminds the couple abput this.
