Legal Question in Family Law in New York

Joint bank account

I have not yet filed for divorce but will be soon. We have already closed our joint bank accounts and opened separate checking & savings accounts. If I have a joint account with my daughter, can my husband still be able to ask for half of my accounts ? I have a signed paper stating that neither one of us is responsible for the others' debts in the future. Will this hold up in court ?

you are doing the right thing by doing what I call pre divorce planning but there is a larger picture that should be addressed. you can call me for a free consultation at 516 466 5297 or ask for my free report "What you should know before hiring a divorce attorney"

Re: Joint bank account

You will continue to held responsible for "necessaries" for your spouse, as your spouse will be for you, notwithstanding statements to World, that you are no longer responsible for each other's debts.

You NEED to retain an attorney and file for Divorce ASAP. Your "stop gap" attempts to "begin" the "process" are likely to create more problems than you solve.

Good luck,
