Joint Residental Custody

What is the Legal Definition of joint legal custody? It needs to be information that can be used in a court of law.

In New York, there is no statutory definition

of Joint Custody. A court is not empowered

to order joint custody. A court may approve

a joint custodial arrangement which has

contractually (in writing) been entered into

between a mother and a father, but it may

not impose such an arrangement on the parties

Because the arrangement is entirely contractual

it can include just about everything. These

may range from true 50% of the time with

each parent to something quite different,

being full access to the children's records

care and activities, but with a more

traditional alternate weekend time share

arrangement.
