Legal Question in Family Law in New York

Joint or Sole Custody

My spouse has a felony conviction and is trying to get joint custody, I am going for sole custody because of the conviction and also he is commiting auldutery and she is making harassing phone calls threatening me. I don;t want my children around violence and crime. Would he possibly be awarded joint custody?

Re: Joint or Sole Custody

Possibly, but if your ex can be shown to be a likely danger to the children, then probably not. The adultery issue is not very likely to have anything to do with it, the felony however, depending, on the nature of the crime, might.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
