Legal Question in Family Law in New York

Jurastiction Mess

Since my ex filed for custody in NY over three years ago this has become the case that never ends. My son and myself have been residents of NY for over three years now, I believe this enables us to a little protection from NJ. So far NJ has failed to do anything and as I am not a lawyer do not know what legal options I have. In my divorce the judge stated again and again he did not want to touch the custody part as the custody agreement stated ''NY shall retain jurastiction in this matter''. When my divorce papers arrived the judge had written in it that ''NY Shall have continuing exclusive jurastiction of the custody matter'' is this even legal??? he stated he wouldnt decide anything related to the custody We live, work, go to school in NJ so why does this need to be in New York? All I want to do is get this to NJ and file a change of circumstance as my son is now going to school. It just keeps getting more and more tangled up, Im tired of getting jerked around. Please I need this solved and getting incredibly frustrated. I just want this in New Jersey Where it belongs!!!

Re: Jurastiction Mess

Jurisdiction is a complex problem, that is true. However, it is clear that you need an attorney's advice: it is not possible to advise you in this format, there are far too many facts that will influence your choice of action, and too many legal principles that will apply. You really need an attorney to defend your interests.
