Legal Question in Family Law in New York

Laws for divorce/separation

My husband and I would like to divorce because we just can't stand each other any more - is this possible in NY or do we have to separate for a year 1st. There is no adultry, cruel and unusual punishment etc. which I see is necessary without a separation in NY - is this true?

Re: Laws for divorce/separation

Most people can get a divorce without having to wait the year. Generally, if we look closely enough at a particular marriage, there are sufficient grounds for divorce. Of course, in your case, I would not know that without meeting with you.

Yes, if you do not have "grounds" you need to be separated, with a signed separation agreement, for one year prior to divorce.
