Legal Question in Family Law in New York

What do I do when my lawyer won't return my phone calls? I am in the middle of getting a divorce (NY state) and he is supposed to be filing for a Request for Judicial Intervention. That was almost six weeks ago. I have made repeated attempts to contact him and all I get is a voicemail. I have left message after message asking what the status is and I have not heard anything. Can I switch lawyers, and if so, will I have to start the process all over again with the new lawyer?

Q. Can I switch lawyers?

A. Yes. You have the right to fire your lawyer and retain another lawyer.

Q. will I have to start the process all over again with the new lawyer?

A. No.

You should also review your bill of rights and responsibilities with a lawyer. You may find the document at: http://www.courts.state.ny.us/attorneys/clientsresponsibilities.shtml.

Mike.
