Legal Question in Family Law in New York

How can I leave my single parent's home for another relative?

I'm fourteen years old and I live with my mother. My father has passed away. I feel that I live in a hostile environment. Though it is not violent, I have, on some occasions been threatened by my mother and her boyfriend. My mother is constantly arguing with me and her boyfriend puts me down and makes me feel extreamly inferior. I feel this is pushing me further and further into depression, if not alresdy there. Also my mother refuses to get me a psycologist. I belive that a child should grow up in a nurturing, non-hostile environment and i shall not get that here. I feel that continuing to live here for the next four years will be hazerdous to my health, as I have an anxiety disorder and possibly depression, both of which go without supervision or treatment. I have been known to become sick from this type of stress on multiple occations and for a few days each time. I think that I would be much safer, happier and healthier living with my aunt, my father's sister. I know she would provide a safe nurturing home for me but I'm not sure if that is legaly possible. At this point my mother has refused me contact with any of my father's relatives; the people I love and am closest to. I just want a normal life. Can you please help me?

I nderstand your question and am sympathetic to what you have written.

The best place to start is with your school psychologist or guidence counselor.

Another place to go is to look up 'Legal Aid' or Legal Services' in your town and make an appointment (you can also walk in.)

Stil another possibility to find a free lawyer is to communicate with a 'womwn's shelter'. Ther are a million women's free legal help options.

Good luck.

If you go to the clerk's office in Family Court, they should help you file a petition. When you finally get before a judge, the Court will likely appoint a law guardian to represent you. If you want to take the time to meet with us, we will consider representing you pro bono. Call our office for an appointment - (212) 255-4077.
