Legal Question in Family Law in New York

Leaving the State

I want to leave the state with my child. I can no longer afford NY, my ex is a dead beat dad. When and if he pays the 150, I still can't afford it here. Can I move?

Re: Leaving the State

Sure you can, but if the ex gets a backbone, he can argue that you shouldn't be able to keep the kid. Hence document all of the time he doesn't send money, the great opportunity you are moving to (line up a really good job first) and the fact that you and your child will not be homeless because your ex doesn't pay enough or on time.

Finally, document all the times he doesn't see his kid. If he has a drug or alcohol problem, make that clear and before you move, SEE A LAWYER!!!

Yeah I know it costs money, but it is better than losing your child to a guy who isn't even able to make a support payment on time.

Good Luck.
