Legal Question in Family Law in New York

I left my home home voluntarily to avoid confrontation. I am not legally separated. My wife changed the locks and is now demanding I change my address or she will throw out my mail. What can I tell her to get her to stop and just leave my mail in the garage for me to pick up, just like she did with my clothes?

It is improper for your wife to throw out your mail, however, given the state of your marriage, I would not want her to be seeing any mail coming to you anyway.

I suggest that you either act to get back into the home or look into changing your address (though there may be consequences for both actions).

I would highly advise that you speak with an attorney as soon as possible. If you would like to me further, please call my office at 631-724-5251.

The easiest solution would be to get a post office box, since once she throws your mail away, there is no getting it back or it is at least, bothersome.

But you could tell her that the home is marital property and that you are entitled to at least use the mailbox. You could also tell her that tampering with mail is a federal crime, if that is the case.
