Legal Question in Family Law in New York

legal age for payments

In New York state, what is the age of majority that a person is responsible for their own medical bills? Our son dislocated his shoulder one week before he was able to get back on our health ins plan as a full time student. He is being billed by the ER, Er drs etc. Must his parents pay the bill or is he liable?

The age of majority in New York is 18 years old. Did your son check himself into the ER? Did he provide your medical card as proof of medical coverage?

If he did provide your medical card, you may still be responsible for his medical bills. If he checked himself into the ER and did not provide your card, he is responsible for paying the bill. Even if your son was a minor at the time he received medical care, he cannot avoid paying the bill because minors are deemed liable for necessaries and medical care is defined as necessaries under the law.
