legal custody
I have sole physical and joint legal custody of our son. My ex left the country on a 30-day ''permit'' from INS over 10 months ago for Romania. He did not file proper papers and now can not come back, apparently.
How do I go about proving this and get sole legal custody?

You can petition the court for a modification of custody and provide any documentation you have substantiating his status. However, the court will have to be convinced that the likelihood of him ever returning are slim before they make a final determination.
