Legal Question in Family Law in New York

is it legal for a husband to hack his wife's email account? He has hacked 2 email accounts, set up a third to route passwords to, and also hacked her facebook account. he then pretended to be her and sent out emails to other people. I should also mention he has vacated their marital premises and she is filing for a divorce. Is it legal for him to do that?
