Legal Question in Family Law in New York
Legal Marriage?
Hi, I got married 2 years ago in Aruba, but never filed any papers or obtained a marriage license here in the States. Is my marriage legal and recognized in the U.S.? I have a marriage license from Aruba. If I wanted a divorce, would I still need to get one? Thank you very much.

Re: Legal Marriage?
Yes, your marriage is legal (as is mine, which was in Anguilla.) The United States and its states give full faith and credit to a marriage overseas, except under the most unusual circumstances.
Yes, you'd need a legal divorce if you wanted one.
Re: Legal Marriage?
Unless there would be a public policy reason for your marriage not to be recognized (bigamist, incestuous etc.) your marriage is valid and legal and would require a divorce.
Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
Re: Legal Marriage?
Yes, it is legal. Yes, you need a divorce.
Since you weren't married in a particular State, you will have to satisfy the residency requirements of the State in which you file for divorce.
Re: Legal Marriage?
Cogratulations: you are a married man. There is no requirement that a marriage be registered in the United Strates for it to be 'legal' here.
You will need a divorce. You should file for divorce in a court in the state in which you live in now (or she lives in now).
