Legal Question in Family Law in New York

Legal Separation and Custody of Minor Child

My husband and I are on the verge of separation and my concern was who gets custody of our child. I also want to move to another state and how does the law touch on this? Please shed some light on this idea.

Re: Legal Separation and Custody of Minor Child

In a constested divorce, custody determinations are based on the best interests of the children. I you and your spouse can agree, you can make any type of custody arrangement that works for you.

I suggest you consult with an attorney.

This subject is much too important and complicated to be handled over the internet. You should speak with a family law attorney. Hopefully you and your spouse can work out these issues otherwise, a judge will decide based upon what is best for the children.
