Legal Question in Family Law in New York
Legal Separations
I was in a marriage where I was repeatedly abused. I am now legally separated. My attorney wasnt pro-active and I ended up with nothing. I am now facing my ex's constant harassment, and he repeatedly breaks our legal agreement. I dont want to go back to the same attorney, but I dont know where to turn? He is trying to get full custody of my daughter, and after the way he treated me, that scares me. I am afraid with my attorney that it could happen. He is an extreme con artist and lies to the court using his family as his witnesses. Please help!

Re: Legal Separations
Sounds just like a case I am working on!!!!
If you are un-happy w/ your atty, fire him/her. Ask the Bar association of the county you live in for a referral to a matrimonial atty.
Have you considered an Order of Protection so that he stops the harrassment? You don't have to be physically abused to be abused.
Make sure you document everything that goes on and take any custody challenge seriously. If you do not have one, ask for a Law Guardian to be assigned for the child.

If you do not feel comfortable with the attorney who represented you in the divorce, you may retain a new attorney, post judgment.
