Legal Question in Family Law in New York
Legal Seperation - What am I entitled to?
I have been married for 4 years, and have had 2 children (2yr & 1yr old) in that time. The house we live in, is in a Coopertive Community, in my husbands name. He purchased the house the 3 years before we married. We rebuilt the house with the money we received from our wedding, increasing the value and community shares, but my name was never put on the house. It's the safest place for children, and I don't want to leave. I have a good job and could manage the household bills, with a little help. He owns his own business and can afford to get an apartment, but he won't leave. I've asked him many many times. How can I get a Legal Separation and keep the house until my boys are a little older? Is that even possible?

Re: Legal Seperation - What am I entitled to?
without the cooperation of your husband you would have to commence an action for divorce. you would be entitled to stay in the house and are entitled to a portion of the appreciation during the marriage. you can call me at 516 466 LAWS for free telephone consultation
