Legal Question in Family Law in New York
Should he be liable to help me more
Okay my question is that if I was 17 when I got pregnant with my first child and I am 7 months pregnant now with my second and only 20. the father of my children and I are split up. Shouldnt He be liable to help me out other than child support. I had to drop out of school when I was 17 and it is hard for me to get on my feet now he barely takes my son for visits. I am not blaming him for my situation but I can not do this alone and for only 50 dollars a week. When I take him to court for child support can I also recieve help from him for myself becuase I was a minor when I got pregnant with my first child

Re: Should he be liable to help me more
NO. You are not entitled to maintenance or a "spousal support," equivilant, since you were never married. Also, you are not entitled to compensation, from the father, for your lost "innocence," opportunities or other things, as if you are a victim of a Tort or "personal injury" action.
A Statutory Rape claim against the father, would have been heard in criminal court. As with most criminal matters the consequences are in the nature of punishment. And, "Restitution" in criminal actions is rare and limited to money matters.
Good luck,
