Legal Question in Family Law in New York
life after divorce
My husband and I are divorcing after 2 years of marriage. We were together for several and over years he has been mentally abusive tome, sometimes ourchildren and got a little physicalat times. Though I never reported anything. We moved to ny to try to patch things uplast falland the attempt failed when he cheated on me. Now he rarely seesour children and talks a lot of bad things about me to friends and family. It is a small town and affects me haveing a normal life.He has no job due to drugs and drinks a lot. He pays no support. Is there any way I can hurry my divorce along since I have not been a resident of ny for 1 yr? I'm not sure how to prove how irresponsible he is? Is there any way I can move backout of state with my children since the marriage didn't work despite my relocation efforts and his lack of maturity? Do I have to put upwith his mental abuse to my children andto me when I do have to see him, and the run around he gives us about visitation?

Re: life after divorce
You should follow the advice of your lawyer if you have already filed for divorce in this state.
If you have yet to take action or consult with an attorney, you might want to take an extended vacation "back home" with your extended family to sort out exactly how you should proceed. You can also consult with a lawyer in your home state to determine whether that state has jurisdiction over your marriage in any way.
